Agreement

These terms apply when you use Ocufuse, including the iPhone app, the web app and this website. By creating an account or using Ocufuse, you agree to them. If you don't agree, please don't use Ocufuse.

Ocufuse ("we", "us") provides the service. Our Privacy Policy explains how we handle your data.

Not medical advice

Ocufuse is not a medical deviceIt does not diagnose, treat, cure, monitor or prevent any disease or condition. Nothing in the app is medical advice. Do not use Ocufuse in an emergency. If your eyes or vision change suddenly, call your local emergency number or see a doctor straight away.

Ocufuse is a journal. It helps you take consistent photos, note what happened, and share that record with a clinician if you choose. Any decision about your health should be made with a qualified professional. Read Safety and intended use before you start.

If you do eye exercises in the Practice section, follow your clinician's instructions and stop if you feel discomfort, strain, headache or dizziness.

Who can use Ocufuse

You must be at least 16 years old. You are responsible for keeping your sign-in details secure and for activity in your account. Tell us straight away if you think someone else has accessed it.

Your content

Your photos, entries and notes belong to you. You give us permission to store, process and display them only as needed to run Ocufuse for you, for example to show your timeline or build a Doctor Brief. This permission ends when you delete the content or your account, subject to backup timing in the Privacy Policy.

Only upload photos of yourself. Don't upload photos of other people without their permission.

Acceptable use

You agree not to:

  • Break the law or anyone's rights while using Ocufuse.
  • Try to access other people's accounts or data, or test the security of the service without our written permission.
  • Interfere with the service, overload it, or use automated means to access it.
  • Copy, resell, or reverse engineer the app, except where the law allows this.

We may suspend or close accounts that break these rules, and will tell you why unless the law prevents it.

Price and availability

Ocufuse is free during early access. If we introduce paid features, we will tell you the price before you are charged, and any App Store purchases are handled by Apple under its terms.

We work to keep Ocufuse available but can't promise it will always be uninterrupted or error free. We may change or remove features. If we plan to shut Ocufuse down, we will give at least 30 days' notice so you can export your data.

Liability

Ocufuse is provided "as is". To the extent the law allows, we make no warranties beyond those stated in these terms, and we are not liable for indirect or consequential losses, or for decisions made based on content in the app.

Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all the rights your local consumer law gives you.

Ending your use

You can stop using Ocufuse and delete your account at any time. We may close your account if you seriously or repeatedly break these terms, or if we are required to by law.

Apple App Store terms

If you downloaded Ocufuse from the App Store:

  • These terms are between you and us, not Apple. Apple is not responsible for the app or its content.
  • Your licence to use the app is limited to Apple devices you own or control, as allowed by the App Store Usage Rules.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation for the app.
  • Apple is not responsible for handling claims about the app, including product liability, legal or regulatory compliance, consumer protection, or intellectual property claims.
  • You confirm that you are not located in a country subject to a US government embargo and are not on any US government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Law and disputes

These terms are governed by the laws of the country where the operator is established. If you are a consumer living elsewhere, you also keep the protection of the mandatory laws of your country, and you may bring a claim in your local courts. Please contact us first so we can try to resolve the issue.

Changes and contact

We may update these terms. For material changes we will tell you in the app or by email at least 14 days before they take effect. Continuing to use Ocufuse after that means you accept the new terms.
